Resident Sues Condo Association and Elevator Company Over Negligence After Elevator Collapse
Alan Cohen has filed a lawsuit against two corporations, alleging negligence after a terrifying elevator incident left him injured. The complaint was lodged on December 4, 2024, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida. The defendants named in the case are Cornwall at Century Village Condominium Association and Delaware Elevator Inc. of Maryland.
According to the complaint, Alan Cohen, a resident of Boca Raton, was using an elevator at his residence in Century Village when disaster struck on March 4, 2024. As he descended from the fourth floor to the first floor, the ceiling of the elevator collapsed unexpectedly. This incident resulted in injuries that Cohen claims were due to negligent maintenance by both defendants. He accuses Cornwall at Century Village Condominium Association of failing to maintain a safe environment and neglecting their duty to inspect and repair potential hazards. Furthermore, he cites Florida Statute § 399.02(5)(b), which mandates elevator owners ensure safe operation and proper maintenance post-certification.
Cohen’s accusations extend to Delaware Elevator Inc., which he alleges had a contractual obligation to maintain the elevator but failed to do so adequately. The lawsuit details how this failure led directly to his injuries and subsequent suffering. “The subject elevator was not maintained in a reasonably safe condition,” Cohen asserts, highlighting what he perceives as clear negligence on behalf of both parties involved.
