UPS Driver Alleges Negligence Against Homeowners and Landscaping Company Over Injury
Gregory Makozy, a UPS delivery driver, has filed a lawsuit against two residents and a landscaping company, alleging negligence that led to his injury. The complaint was filed by Makozy in the Circuit Court of the 15th Judicial Circuit in Palm County, Florida on February 4, 2025, targeting defendants Thomas and Linda Rizk and Elegant Landscape and Design, Inc.
The case revolves around an incident that occurred on December 5, 2022. According to the filing, Makozy was performing his duties as a delivery driver when he visited the premises owned by Thomas and Linda Rizk at 11778 Calleta Ct., Palm Beach Gardens. During this visit, Makozy claims he encountered an unreasonably dangerous condition—specifically, a waxed driveway with no warning signs or safety measures such as yellow tape or signage indicating potential hazards. This oversight allegedly resulted in Makozy falling and sustaining injuries.
Makozy’s complaint outlines that the Rizks had a legal duty to maintain their property safely for visitors. “Defendant negligently operated, maintained, and/or inspected the premises,” reads the complaint. The plaintiff argues that the hazardous condition was either created by or known to the defendants or had existed long enough for them to have been aware of it. As a result of this negligence, Makozy suffered injuries affecting his body and extremities, incurred medical expenses for treatment, experienced pain and physical handicap, and faces ongoing impairment.
