A Texas resident is seeking justice after his Florida property suffered extensive water damage due to alleged negligence by a local company. Robert Alpert filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on August 20, 2024, against CA Lindman, Inc., and CA Lindman of South Florida, LLC.

The lawsuit centers around an incident that occurred on February 28, 2023. According to the complaint, an employee of the defendants was working on a condominium unit directly above Alpert’s property at 2000 South Ocean Blvd., Unit 104N in Palm Beach. During this work, the employee allegedly broke an outdoor water pipe located inside an exterior wall on the balcony. This mishap resulted in massive flooding and significant water damage to Alpert’s unit.

Alpert claims that the defendants were negligent in several ways: failing to use due care which led to the breaking of the water pipe; not taking adequate measures to prevent damage; failing to properly train their employees for such tasks; and generally not exercising reasonable care to avoid causing harm. As a result of these alleged failures, Alpert’s property sustained extensive damage including but not limited to drywall and flooring issues, as well as damage to furnishings and other belongings. The development of mold and other toxins necessitated remediation efforts. Additionally, Alpert faced loss of rental income and incurred various expenses related to repairing his property.
