Tenant Alleges Negligence Against Housing Foundation Over Sidewalk Fall
A woman has filed a lawsuit against a housing foundation, claiming negligence after suffering injuries from a fall on their property. On March 7, 2025, Gama Philippe filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against The NHP Foundation, Inc., doing business as Clipper Cove Apartments.
The incident that sparked this legal battle occurred on February 7, 2023. Gama Philippe was walking on the sidewalk within the premises of Clipper Cove Apartments when she tripped over an uneven section of the sidewalk and sustained severe injuries. According to the complaint, Philippe’s fall was due to the defendant’s negligence in maintaining safe conditions on their property. The lawsuit claims that the defendant failed to regularly inspect and remedy dangerous conditions or provide adequate warnings about them. “As a direct and proximate result of Defendant’s negligence,” reads the complaint, “Plaintiff sustained grievous bodily injuries.”
Philippe accuses The NHP Foundation of several acts of negligence. She alleges that they did not inspect or maintain the sidewalk area properly to ensure it was free from hazards like uneven surfaces. Furthermore, she claims they failed to warn her about these dangerous conditions and allowed such conditions to persist. These alleged failures led to her physical injuries, which have caused pain, medical expenses, physical handicap affecting her ability to work, and potential future losses in earnings and quality of life.
