The complaint was lodged on October 23, 2024, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, naming M3 5851 Corp., doing business as Jumbo Supermarket, as the defendant.

The incident at the heart of this case occurred on June 4, 2022. Alvarez was shopping at Jumbo Supermarket located at 5851 Lake Worth Road in Greenacres, Florida. While approaching the cash register, she suffered a laceration to her hand caused by a sharp cashier shield placed on the register counter. According to Alvarez’s complaint, this injury resulted in “serious personal injuries,” which have had lasting effects on her health and quality of life.

Alvarez alleges that the supermarket failed in its duty to maintain safe premises for its customers. The complaint outlines that Jumbo Supermarket had an obligation to ensure their premises were free from hazards and to warn customers of any concealed dangers that could not be easily discovered by patrons exercising due care. The plaintiff argues that the supermarket breached this duty by allowing an unreasonably sharp shield to remain in place without warning customers of its potential danger.
