Stacey Moe, a resident of Pinellas County, Florida, has filed a lawsuit seeking damages exceeding $50,000 against the Florida Department of Transportation and Asset Management Webber. The complaint was lodged in the Circuit Court of the Sixth Judicial Circuit in Pinellas County on February 18, 2025. Moe alleges that negligence on the part of these entities led to a serious accident while he was riding his motor scooter.

The case centers around an incident that occurred on April 26, 2024, when Moe was traveling along Gulf Boulevard in Madeira Beach. According to the complaint, Moe hit a pothole approximately one foot deep while riding in the bike lane, causing him to fall off his scooter and sustain significant injuries. The lawsuit accuses both defendants of failing to maintain safe road conditions and neglecting their duty to inspect and repair hazardous areas effectively.

Moe’s legal team argues that the Florida Department of Transportation had a responsibility to ensure the safety of public roads and bike lanes but failed to do so. The complaint states that they “negligently failed to maintain or adequately maintain” these areas, allowing them to remain in a dangerous condition. Furthermore, it is alleged that they did not provide adequate warnings about existing hazards like the pothole that caused Moe’s accident.
