The case revolves around an incident that occurred on March 15, 2023, when Rocio Vicente, a tenant at Wellington Apartments in Clearwater, Florida—owned and managed by Starwood Capital Group Holdings—slipped and fell due to an accumulation of browned leaves and debris in the parking lot. Vicente claims that the defendant failed to maintain safe conditions on the premises and neglected their duty to warn her about potential hazards. According to the complaint, “Defendant owed Plaintiff duties to maintain the premises in a reasonably safe condition,” which they allegedly breached through various omissions.

Vicente’s allegations include multiple instances of negligence: failing to maintain or adequately inspect the parking lot surfaces for hazardous conditions; not warning tenants like Vicente about potential dangers; and neglecting to implement adequate policies or training for employees regarding safety inspections. She asserts that these failures led directly to her fall and subsequent injuries, which have resulted in significant physical harm and financial losses.
