Victoria Carney has filed a negligence complaint against Guanabanas Restaurant, Inc., 960 AlA LLC, and Florida Preferred Service, LLC. The lawsuit was filed in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida on May 22, 2024.

The plaintiff, Victoria Carney, alleges that she sustained significant injuries due to the negligence of the defendants. On May 25, 2020, Carney was a guest at Guanabanas Restaurant located at 960 N. Highway A1A in Jupiter, Florida. According to the complaint, a fabric tarp installed above the valet station at the restaurant collected rainwater and subsequently detached from its fixtures, collapsing onto Carney and causing her serious injuries.

Carney’s lawsuit details several allegations against each defendant. She claims that Guanabanas Restaurant failed to maintain its premises in a safe condition and did not warn patrons about the hazardous condition of the tarp. The complaint states that “the Defendant had actual knowledge or should have known with reasonable care and investigation that the fabric tarp cover could collect rainwater, detach from its fixtures and collapse.” Furthermore, it accuses Guanabanas of failing to properly install and inspect the tarp.
