Plaintiff sues Cafe Barista Inc., operator of local restaurant chain for Negligence
Selena Carlotta Ceballos has filed a lawsuit against a local restaurant, alleging negligence after suffering an injury on their premises. The complaint was filed by Ceballos in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on January 29, 2025, targeting Cafe Barista Inc., doing business as Hurricane Alley Raw Bar & Restaurant.
The case revolves around an incident that occurred on September 8, 2023, when Ceballos was dining at Hurricane Alley Raw Bar & Restaurant located at 529 E Ocean Ave, Boynton Beach, FL. According to the complaint, while attempting to sit down and pulling her chair forward, Ceballos encountered a detached cushion which led to her left index finger sustaining an open fracture and laceration. The plaintiff claims that this injury was due to the negligence of Hurricane Alley in maintaining safe conditions for its patrons.
Ceballos asserts that Hurricane Alley had a duty to ensure the safety of its customers by maintaining the premises in a reasonably safe condition. This includes inspecting furniture for hazardous conditions and properly training employees to handle maintenance tasks effectively. The complaint accuses Hurricane Alley of failing to identify and rectify the dangerous condition posed by the sharp area under the chair cushion, which directly contributed to her injury.
