Plaintiff injured gym member sues fitness center and property owner over negligence
A gym-goer is taking legal action after a workout turned into a nightmare due to faulty equipment. Maxol Cimeus filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on January 17, 2025, against Fitness International, LLC, doing business as LA Fitness, and Pine Trail Square, LLC.
The lawsuit stems from an incident that occurred on October 23, 2023. Maxol Cimeus was working out at the LA Fitness gym located within Pine Trail Square when a belt on the leg exercise machine snapped, causing him injury. According to the complaint, Cimeus was legally on the premises as a business invitee when the accident happened. The plaintiff claims that both defendants were negligent in maintaining safe conditions at their facilities.
Cimeus alleges that LA Fitness failed to maintain its premises safely and neglected to correct or warn about dangerous conditions they knew or should have known existed. The complaint states that LA Fitness did not adequately train its employees to inspect for or repair such hazards. It also accuses them of engaging in negligent business operations. “LA Fitness had actual or constructive knowledge of the dangerous condition and failed to take action to remedy it,” reads one part of the document.
