Miguel Brito Yanez has filed a lawsuit against Home Depot U.S.A., Inc., alleging negligence after sustaining injuries on their premises. The complaint was filed in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on October 4, 2024.

According to the details of the case, Miguel Brito Yanez claims that on July 18, 2023, while he was lawfully present as a business invitee at Home Depot’s establishment located at 1400 Waterford Place in Delray Beach, Florida, he suffered a significant injury. A metal sheet attached to a shopping cart obstructed his path and cut through his hand. This incident led to serious and permanent injuries for Yanez. The plaintiff asserts that Home Depot had a duty to maintain a safe environment for its customers but failed to do so by allowing such hazards to exist within their premises.

The lawsuit emphasizes that the hazardous condition persisted long enough for Home Depot to have been aware of it and taken action to rectify it. Due to this alleged negligence by Home Depot and its employees or agents, Yanez endured not only physical pain and suffering but also mental anguish, disability, disfigurement, loss of enjoyment of life, medical expenses, and loss of earnings. These damages are claimed to be ongoing and possibly permanent.
