A woman has filed a lawsuit against a well-known restaurant chain, alleging negligence after suffering injuries at one of its locations. Delane Bacon filed the complaint in the Circuit Court of the Sixth Judicial Circuit of Florida, located in Pinellas County, on March 11, 2025. The defendants named in the lawsuit are Texas Roadhouse Holdings LLC, Texas Roadhouse Management Corp., and Platinum Holdings 1, LLC.

The case revolves around an incident that occurred on December 9, 2023, when Delane Bacon visited a Texas Roadhouse restaurant located at 10105 Bay Pines Blvd in St. Petersburg, Florida. As per the complaint, Bacon was a business invitee at the establishment when she suffered injuries due to what she claims was an “unreasonably dangerous and unnecessary step down” from an elevated booth where she had been seated for dinner. The lawsuit alleges that the defendants failed to maintain the premises in a reasonably safe condition and neglected their duty to inspect and rectify any hazardous conditions that could pose risks to customers like Bacon.

Bacon’s legal representation argues that as owners and operators of a public business establishment, Texas Roadhouse Holdings LLC and its associated entities had an obligation to ensure the safety of their patrons by maintaining safe premises. This includes inspecting for potential dangers and providing warnings about any hazardous conditions that may not be immediately apparent to guests exercising due care. The plaintiff contends that this failure directly resulted in her sustaining bodily injury along with subsequent pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings capacity, and aggravation of pre-existing conditions.
