Plaintiff Alleges Negligence Against Property Owner Over Hazardous Condition
Patrick Hart has filed a lawsuit against a corporate entity, alleging negligence after suffering injuries due to an unsafe condition on their property. The complaint was lodged by Hart in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on February 7, 2025, targeting Corporate Midwest Investment LLC TRE as the defendant.
The case revolves around an incident that occurred on February 11, 2024, when Patrick Hart was injured while renting a home from Corporate Midwest at 842 22nd Avenue South in St. Petersburg, Florida. According to the complaint, Hart tripped and fell over an unlevel manhole on the property while blowing leaves off the driveway. This fall resulted in severe and permanent injuries requiring medical treatment and causing significant pain and suffering. Hart’s legal team argues that Corporate Midwest had a duty to maintain the premises safely for invitees like him but failed to do so.
The plaintiff accuses Corporate Midwest of negligence for not maintaining the manhole properly and failing to warn about its hazardous condition. “Defendant negligently allowed the manhole to become and remain in a hazardous condition,” states the complaint. It further claims that Corporate Midwest did not conduct reasonable inspections or repairs and neglected to warn Hart or other invitees about this danger. These failures allegedly led directly to Hart’s injuries, including bodily harm, mental anguish, disability, loss of enjoyment of life, and incurred medical expenses.
