Plaintiff Alleges Negligence Against Nursing Home Leading To Severe Injuries
A recent court filing has brought to light serious allegations against a rehabilitation center in Palm Beach County, Florida. Estevez Rosy, acting as Power of Attorney for Camelia Cardoso, filed a complaint on June 18, 2024, against Wellington Rehab and Health Center, LLC, doing business as The Luxe at Wellington Rehabilitation Center.
The complaint alleges that the defendant’s negligence led to severe pressure injuries for Ms. Cardoso during her stay at the facility. According to the document, Ms. Cardoso was admitted to The Luxe at Wellington on June 25, 2022, without any documented pressure injuries. However, within two days of her admission, she developed deep tissue injuries (DTIs) on both heels due to the facility’s failure to conduct an accurate assessment and implement a proper care plan. “Had Defendant’s staff completed an accurate assessment and developed and implemented a more aggressive plan of care to prevent skin breakdown,” the complaint states, “Ms. Cardoso would not have developed multiple severe pressure injuries.”
The lawsuit details numerous failures by the facility’s staff including delayed implementation of pressure reduction interventions and wound treatments. For instance, although DTIs were identified on June 27, 2022, treatments were not initiated until two days later. Furthermore, records indicate multiple missing entries regarding bed mobility during Ms. Cardoso’s initial 48 hours post-admission—a critical period for preventing such injuries.
