Plaintiff alleges negligence against medical pavilion owner over unsafe conditions
In a dramatic turn of events, a resident of Palm Beach County has filed a lawsuit against a medical pavilion owner and its manager, citing negligence that led to personal injury. The complaint was filed by Bruce William Kerman in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on January 6, 2025. The defendants named in the case are CPI/AHP Gardens Medical Pavilion MOB Owner, L.L.C., and an individual identified as John Doe.
The case centers around an incident that occurred on June 20, 2024, at the premises located at or near 3401 PGA Blvd in Palm Beach County. Kerman claims he was injured when a door closed on his arm due to alleged negligent maintenance of the property by the defendants. According to the complaint, Kerman visited the premises as a business invitee and suffered injuries because of what he describes as “negligent acts” by both CPI/AHP Gardens Medical Pavilion MOB Owner and John Doe.
Kerman’s allegations are detailed in two counts of negligence against each defendant. Against CPI/AHP Gardens Medical Pavilion MOB Owner, L.L.C., Kerman accuses them of failing to maintain safe conditions on their property. He asserts that they created a hazardous environment for patrons by not correcting known dangers or warning visitors about them. “By carelessly and negligently failing to maintain the grounds…Defendant created a dangerous condition,” reads one part of the complaint.
