According to the complaint, on October 2, 2024, Caplan was injured when an “arm-gate” at the defendants’ property suddenly descended onto her head as she was exiting in a convertible vehicle. This incident occurred at approximately 12:30 PM at the property located at 6395 Castle Gate Boulevard in Boynton Beach. As a result of this unexpected mechanical failure, Caplan claims to have suffered serious bodily harm leading to ongoing pain and suffering, mental anguish, loss of enjoyment of life, and permanent impairment.
Caplan’s lawsuit accuses both defendants of failing to uphold their duty of care towards residents and visitors by neglecting proper maintenance and safety protocols for the property’s mechanical barriers.
