A man is seeking justice after a seemingly innocuous trip to a pharmacy turned into a life-altering incident. On February 28, 2025, Stephen Davis filed a complaint in the Circuit Court for the Sixth Judicial Circuit in Pinellas County, Florida, against Holiday CVS, L.L.C., CVS Pharmacy, Inc., Barbara Ann Baynard, and Larry Baynard, Trustee of the Edward Baynard Revocable Trust Agreement.

The case stems from an incident on March 2, 2023, when Davis was conducting a retail audit at a CVS store located at 5801 Central Avenue in St. Petersburg. While walking towards the store’s entrance, he tripped over an uneven sidewalk edge and fell onto the concrete. This fall resulted in significant injuries including a right tibial plateau fracture and right knee injuries. Davis claims that these injuries have led to ongoing pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, and loss of earnings.

Davis accuses Holiday CVS and CVS Pharmacy of negligence for failing to maintain safe premises. He alleges that both entities were aware or should have been aware of the hazardous condition of the sidewalk but failed to address it or warn visitors like himself. The complaint states that “Defendant HOLIDAY CVS breached this duty of care” by allowing the sidewalk to become dangerous and not inspecting or warning about its condition.
