Plaintiff Alleges Negligence Against Condominium Association Over Unsafe Premises
Kathleen Bailey has taken legal action against a condominium association after suffering significant injuries due to an alleged unsafe condition on their property. According to the complaint, Kathleen Bailey visited the premises of Vantage Point Condominium located at 10200 Gandy Boulevard North, St. Petersburg, Florida, on December 1, 2023. As a lawful guest and business invitee, she claims that Vantage Point had a nondelegable duty to ensure her safety while on their property. However, Bailey alleges that the condominium association failed in this duty by not maintaining a safe environment for visitors.
The crux of Bailey’s lawsuit centers around an incident where she fell due to a loose handrail that was not properly secured to the wall. The complaint accuses Vantage Point of several negligent actions including failing to maintain or adequately inspect the stair railing which created an unreasonably dangerous condition for guests like Bailey. It is further alleged that Vantage Point either knew or should have known about this hazardous condition but did not take appropriate measures to correct it.
