According to the complaint, Montero visited the premises at 3570 South Ocean Boulevard as a business invitee on November 19, 2024. During her visit, she unexpectedly slipped on a slippery substance identified as paint. The plaintiff asserts that this incident resulted in significant bodily injury. Montero alleges that the defendant failed to maintain safe conditions on their property and neglected their duty to protect visitors from potential hazards. The lawsuit accuses The Tuscany of Palm Beach of multiple counts of negligence, including failing to maintain the walkway near an elevator and not adequately inspecting or warning about dangerous conditions.

Montero’s legal team claims that the defendant breached its non-delegable duty by allowing hazardous conditions to persist. They argue that the defendant did not have adequate policies or staff in place to prevent such incidents despite prior knowledge of similar occurrences. Furthermore, it is alleged that employees were inadequately trained to handle these risks effectively.
