Plaintiff alleges national retailer’s negligence led to serious injury
A Pinellas County resident has taken legal action against a national retail giant following an incident that left her injured. Janet Gardner filed a complaint on December 17, 2024, in the Circuit Court for the Sixth Judicial Circuit in Pinellas County, Florida, against Home Depot U.S.A. Inc., seeking damages exceeding $50,000.
The case revolves around an incident that occurred on July 28, 2028, at a Home Depot store located at 10689 Ulmerton Road in Largo, Florida. According to the complaint, Gardner was loading items into her vehicle when she tripped over tree branches scattered across the parking lot’s uneven surface. The lawsuit alleges that Home Depot failed to maintain the parking lot in a safe condition and neglected to warn customers of potential hazards. Gardner’s legal team argues that Home Depot had a duty to ensure the safety of its premises by removing debris and warning patrons of any latent dangers.
Gardner claims that as a result of Home Depot’s negligence, she suffered permanent personal injuries and continues to endure pain and suffering. The complaint outlines various damages including mental anguish, physical limitations, decreased enjoyment of life, loss of earnings, and medical expenses related to her injuries. The plaintiff asserts that these damages were directly caused by Home Depot’s breach of duty in maintaining their property.
