Plaintiff alleges Evernia Health Center LLC of Retaliation Under the FMLA
A former employee has taken legal action against a health center, alleging retaliation following her attempt to exercise her rights under the Family and Medical Leave Act (FMLA). Faye Williams filed a complaint on October 9, 2024, in the Circuit Court for Palm Beach County, Florida, accusing Evernia Health Center LLC of wrongful termination.
Williams claims that during her tenure as a Program Manager at Evernia Health Center from August 2020 until August 6, 2024, she was unlawfully terminated after seeking medical leave due to a relapse of a condition covered by the FMLA. Her responsibilities included planning events and taking clients on outings. Despite being in remission when hired, Williams relapsed in March 2024 and subsequently informed her supervisor, Kate Rosobough, about her need for rehabilitation around July 10, 2024. She officially entered rehab on July 23, 2024.
During weekly meetings with Rosobough between July 23 and August 5, Williams discussed her progress and job status. On August 5, Rosobough indicated that Williams would not be pleased with the decision regarding her employment but assured assistance with FMLA application paperwork. The following day, Williams received an email from Human Resources representative Amy Bravo containing a termination notice.
