Orlita Kelly has filed a lawsuit against three Florida-based companies, accusing them of negligence that led to her sustaining injuries. The complaint was lodged in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on February 20, 2025. The defendants named in the case are 3365 Burns Road Partners, LLC; KD Commercial Real Estate, LLC; and KD Commercial Property Management, LLC.

The lawsuit stems from an incident on March 6, 2023, when Kelly visited a medical office building located at 3365 Burns Road in Palm Beach Gardens. According to the complaint, she tripped and fell due to an uneven walking surface at the entrance of the property—a hazard that was not marked with warning signs or barricades. As a business invitee at the time of the accident, Kelly asserts that all three defendants had a duty to maintain safe conditions on their premises but failed to do so.

Kelly’s complaint outlines several allegations against each defendant. She claims that 3365 Burns Road Partners, LLC (referred to as “OWNER”) owned and managed the property and had a non-delegable duty to ensure its safety. The plaintiff accuses OWNER of negligence for failing to maintain safe conditions and not providing adequate warnings about the defective surface. Similarly, KD Commercial Real Estate, LLC (“MANAGEMENT”) and KD Commercial Property Management, LLC (“PROPERTY MANAGER”) are accused of similar breaches in their duties regarding managing and maintaining the property safely.
