Plaintiff accuses local government entities of negligence over hazardous sidewalk
A woman has filed a lawsuit against two local government entities, accusing them of negligence that led to her severe injuries. On February 10, 2025, Marylynn Symanski filed a complaint in the Sixth Judicial Circuit Court in Pinellas County, Florida, against Pinellas County and the City of Belleaire Beach. The complaint alleges that both defendants failed to maintain a sidewalk in a safe condition, resulting in Symanski’s fall and subsequent injuries.
According to the court documents, Symanski claims that while she was visiting an area near 2900 Gulf Blvd in Belleair Beach, she tripped on an uneven sidewalk. This incident allegedly caused her significant personal injuries. The plaintiff asserts that both Pinellas County and the City of Belleaire Beach had a duty to ensure the sidewalk was safe for public use but failed to do so. The lawsuit details how the defendants allegedly neglected their responsibilities by not maintaining or inspecting the sidewalk properly and failing to warn pedestrians about its dangerous condition.
Symanski’s legal action is based on premises liability and negligence claims against both governmental entities. She argues that their negligence directly resulted in her bodily harm, which includes pain and suffering, disability, disfigurement, permanent scarring, mental anguish, loss of enjoyment of life, medical expenses, loss of earnings capacity, and aggravation of pre-existing conditions. “The losses are either permanent or continuing,” states the complaint, emphasizing that Symanski will continue to suffer from these injuries in the future.
