A Palm Beach County resident has filed a lawsuit against a major home improvement retailer and its store manager, alleging negligence that led to serious injuries. Fernanda Rodriguez lodged the complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on August 8, 2024, targeting Lowe’s Home Centers, LLC and Eric C. Perry, the store manager.

According to the court documents, Rodriguez was a business invitee at the Lowe’s located at 21870 State Road 7 in Boca Raton on February 10, 2024. After completing her shopping, she returned to her vehicle in the store’s parking lot and tripped over a dry and raised piece of cement near her car. The fall resulted in significant bodily injuries for Rodriguez. The plaintiff asserts that Lowe’s had a non-delegable duty to maintain its premises safely and that Perry was responsible for ensuring compliance with safety policies and procedures.

Rodriguez claims that both defendants breached their duty of care by failing to maintain or adequately inspect the parking lot for hazards like raised cement patches. She further alleges that they failed to warn her about these dangers or correct them despite knowing—or having ample time to know—about such conditions. “Negligently failing to inspect or adequately inspect the premises parking lot… thus creating an unreasonably dangerous condition,” reads one part of the complaint.
