A Pinellas County resident has filed a lawsuit against her neighbor, alleging negligence that led to severe property damage and health issues. Barbara Mendelsohn filed the complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on July 26, 2024, accusing Tina E. Wallace of causing water damage and black mold infestation.

According to the court documents, Mendelsohn claims that Wallace negligently maintained her property at 2663 Sabal Springs Circle, Unit 201, Clearwater, Florida. On November 7, 2023, water leaked from Wallace’s apartment into Mendelsohn’s unit below, resulting in significant water damage and the growth of black mold. The plaintiff alleges that this negligent maintenance caused her to suffer from headaches and respiratory issues due to mold exposure. Additionally, she reports extensive property damage affecting furniture, clothing, shoes, and other personal items.

Mendelsohn asserts that Wallace had a duty to maintain her apartment in a reasonably safe condition and prevent water accumulation that could lead to leaks and mold growth. “Defendant breached that duty by allowing water to accumulate and leak into the apartment directly below hers,” states the complaint. This breach allegedly created a hazardous living environment for Mendelsohn.
