In the Fifteenth Judicial Circuit Court of Palm Beach County, Florida, plaintiffs Michael Michaud and Inasia Angele Jovan Michaud, individually and on behalf of their minor daughter Mikayla J. Michaud, have filed a lawsuit against Boca Raton Regional Hospital Inc., Baptist Health South Florida Inc., Sharon M. Smith-Thomas M.D., Lucina Women’s Health LLC, Julia Depass R.N., and Kathy O’Donoghue R.N. The case (ID: 502024CA003631 XXXAMB Div: Al) was filed on April 18, 2024.

The lawsuit alleges medical negligence under Chapter 766 of the Florida Statutes and Rule of Civil Procedure 1.650. The plaintiffs claim that the defendants failed to provide adequate healthcare services which resulted in damages exceeding $50,000. The plaintiffs have complied with all conditions precedent prior to filing this action as per Florida Statute 766.

The complaint further details that written Notice of Claim was provided to the defendants via certified mail as per Florida Statute 766.106 and Rule of Civil Procedure 1.650.
