Local Resident Sues Nursing Home Over Alleged Negligence Leading to Severe Injuries
A Palm Beach County resident has filed a lawsuit against a local nursing and rehabilitation center, alleging negligence that resulted in serious injuries. Joanna Benton lodged the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on August 1, 2024, targeting Boca Opco, LLC doing business as Boca Delmar Nursing and Rehabilitation Center.
According to the complaint, Benton was lawfully on the premises of Boca Delmar Nursing and Rehabilitation Center located at 375 NW 51st Street in Boca Raton on January 10, 2023. The plaintiff claims that Boca Opco, LLC had a duty to maintain a safe environment for all individuals legally present on their property. Specifically, Benton asserts that the facility failed to keep its premises free from dangerous conditions and neglected to warn visitors about potential hazards.
The core of Benton’s allegations centers around an incident where she slipped and fell on a wet floor inside room 152 of the facility. The complaint states that there were no warning signs indicating the wet floor condition. “BOCA OPCO, LLC knew of the existence of this unreasonably dangerous condition or should have known of its existence through a reasonable inspection,” reads one part of the filing. As a result of this alleged negligence, Benton sustained severe injuries affecting her face, body, and extremities. These injuries have led to significant pain and suffering, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life, and substantial medical expenses.
