A woman is seeking over $50,000 in damages after tripping and falling in a hotel parking lot, according to a recent court filing. Marcy Heuman filed the complaint against AVR Boca Center Hotel LLC and MPF Vanderbilt Boca Property LLC in the Circuit Court of the 15th Judicial Circuit in Palm Beach County on July 1, 2024.

The lawsuit alleges that both defendants failed to maintain a safe environment in their shared parking lot at 5150 Town Center Circle, Boca Raton. On May 11, 2024, Heuman was walking towards her parked car when she tripped over an unlevel and broken section of the parking lot. The complaint states that this hazardous condition caused her to suffer “permanent and severe bodily injury.”

Heuman’s attorney argues that both AVR Boca Center Hotel LLC and MPF Vanderbilt Boca Property LLC had a duty to ensure the safety of their premises for guests. The complaint claims that they neglected this duty by allowing the parking lot to remain in a dangerous state with uneven surfaces, potholes, cracks, and abrupt changes in elevation. “Defendants had or should have had knowledge greater than that of Plaintiff,” reads one part of the filing.
