A slip-and-fall incident has escalated into a legal battle, with serious allegations of negligence at the heart of the matter. Joshua Nutter filed a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on March 12, 2025, against Marlene Burke. The case revolves around an accident that occurred while Nutter was cleaning a pool on Burke’s property.

According to the complaint, Joshua Nutter visited Marlene Burke’s residence as a business invitee or guest to perform maintenance on her pool on March 14, 2023. During this visit, Nutter claims he slipped and fell due to algae growth on the pool deck and border, which he alleges was negligently maintained by Burke. The plaintiff asserts that Burke failed to uphold her duty to ensure a safe environment for him as a lawful guest. “Defendant owed Plaintiff duties to maintain the premises in a reasonably safe condition,” states the complaint.

Nutter accuses Burke of several negligent acts or omissions. He claims she failed to adequately maintain the pool area, allowing algae to grow unchecked and create hazardous conditions. Furthermore, he alleges that Burke did not provide sufficient warning about these dangers despite knowing or having reason to know about them. As a result of this alleged negligence, Nutter suffered significant personal injuries after slipping on the algae-covered surface.
