Guardian Sues Major Retailer Over Child’s Injury Due to Alleged Negligence
Taylor Davis has filed a lawsuit against a major sporting goods retailer following an incident that left her daughter, Olivia Davis, injured. The complaint was lodged in the Sixth Judicial Circuit in Pinellas County, Florida on December 13, 2024, naming Dick’s Sporting Goods, Inc. and its manager Jennifer Uhl as defendants.
The case revolves around an unfortunate event that occurred on October 19, 2024, at a Dick’s Sporting Goods store located at 6775 22nd Ave N in St. Petersburg, Florida. According to the complaint filed by Taylor Davis as the guardian of her minor daughter Olivia Davis, the young girl was visiting the store when she was struck by a barbell that had been improperly secured. The barbell fell from its holder and hit Olivia above her right eye before landing on her chest, causing significant injuries.
The lawsuit accuses Dick’s Sporting Goods of negligence for failing to maintain a safe environment for its customers. It alleges that the company breached its duty by allowing a hazardous condition to exist — specifically by not fastening or balancing the barbell properly. “The Defendant owed a non-delegable duty to maintain said premises in a reasonably safe condition,” states the complaint. It further argues that this negligence led directly to Olivia’s injuries which include bodily harm and resulting pain and suffering.
