A former employee is suing a local restaurant for alleged retaliation after reporting discriminatory practices. Flynn Novak filed the complaint against Island Way Grill, Inc. in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on September 3, 2024.

According to the court documents, Flynn Novak was employed as a server at Island Way Grill from March 13, 2024, until June 20, 2024. During his employment, Novak claims he became aware of discriminatory actions taken by the restaurant against a pregnant employee. These actions allegedly violated several laws including the Florida Civil Rights Act and Title VII of the Civil Rights Act of 1964. “Novak objected to Island Way’s discriminatory practices against the pregnant employee and reported these violations to his supervisors,” states the complaint.

Novak alleges that his objections led to his termination on June 20, 2024. He contends that this termination was an act of retaliation in direct violation of the Florida Private Whistleblower Act (Fla. Stat. § 448.102). The statute protects employees from retaliatory personnel actions when they disclose or object to activities that violate laws or regulations.
