Former Employee Alleges Racial Discrimination by Health Insurance Agency
A former employee has filed a lawsuit alleging racial discrimination against his previous employer, a health insurance agency. Eric Nicastro lodged the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on December 4, 2024, targeting Health Insurance King Agency, LLC.
The lawsuit outlines a series of grievances Nicastro faced during his tenure at the agency, which began in November 2022. As the sole Caucasian employee among his peers, Nicastro claims he was subjected to racial slurs and derogatory nicknames such as “Cracker Eric.” Despite being one of the top performers at Health Insurance King Agency, Nicastro alleges that he faced discriminatory treatment that culminated in his termination on July 7, 2023. The incident leading to his dismissal involved a minor altercation with a non-Caucasian co-worker named Adrian over touching a paper bag. According to Nicastro’s account, it was Adrian who caused a scene; however, Louis Maldonado, a non-Caucasian supervisor at the agency, sent Nicastro home and subsequently terminated him via phone call later that day.
Nicastro’s complaint asserts that Health Insurance King Agency violated the Florida Civil Rights Act of 1992 by discriminating against him based on race. He accuses the company of denying him job opportunities and subjecting him to harassment due to his race. The plaintiff argues that these actions were intentional and maliciously disregarded his rights under state law. The complaint details various damages Nicastro claims to have suffered as a result of this discrimination: damage to reputation and self-esteem, loss of income and earning capacity, emotional distress including stress and anxiety, significant pain and suffering both past and future, as well as other financial losses.
