Florida Shopper Sues Local Businesses Over Carbon Monoxide Poisoning Incident
Ilene Weber, a Florida resident, has filed a lawsuit against several defendants after suffering from carbon monoxide poisoning while shopping. The complaint was filed on November 26, 2024, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida. The defendants named in the case are Ronald Axelrod, Point Cleaners Inc., and Colliers International Florida LLC.
According to the lawsuit, Weber claims she was exposed to dangerous levels of carbon monoxide while visiting “Ronnie’s Shoes,” a store owned by Ronald Axelrod located in the King’s Point Shopping Center in Delray Beach. On January 24, 2024, Weber noticed two employees exhibiting signs of distress such as labored breathing and confusion. Emergency services were called, and upon arrival, Fire Rescue evacuated the shopping center due to an active carbon monoxide leak. The source of this leak was traced back to a defective boiler at Point Cleaners Inc., a neighboring business.
Weber accuses the defendants of negligence for failing to maintain their premises safely and for not having proper carbon monoxide detection equipment installed. She alleges that Ronald Axelrod did not uphold his duty to ensure “Ronnie’s Shoes” had adequate safety measures against such hazards. Similarly, Point Cleaners is accused of neglecting their responsibility to maintain their equipment properly and prevent harmful gas leaks. Colliers International Florida LLC is also held accountable for not overseeing their tenant’s maintenance practices and ensuring the shopping center had necessary safety devices.
