A Florida man has filed a lawsuit against a prominent resort, alleging negligence after a slip-and-fall incident that resulted in serious injuries. The complaint was filed by Massoud Dabiri on June 19, 2024, in the Sixth Judicial Circuit Court in Pinellas County, Florida, against Sandpearl Resort, LLC.

According to the court documents, Dabiri claims that on April 10, 2024, he was an invitee at the Sandpearl Resort located at 500 Mandalay Ave, Clearwater, FL. While exiting a restroom adjacent to the pool area, he slipped and fell due to water on the floor. Dabiri asserts that the resort negligently maintained its premises by allowing a hazardous condition to exist.

The plaintiff alleges that Sandpearl Resort had a non-delegable duty to maintain its premises in a reasonably safe condition and to warn guests of any potential dangers. The complaint states that the resort breached this duty by permitting water to remain on the restroom floor and failing to provide adequate warnings or take remedial action. “The Defendant had actual or constructive knowledge of the dangerous condition and took no action to remedy it,” reads one part of the filing.
