The Estate of a deceased woman has filed a significant lawsuit against several retirement community entities and individuals, alleging negligence and breach of fiduciary duty that led to her suffering and eventual death. The complaint was filed by Donald Joseph Feith, the personal representative of Virginia Lenore Feith’s estate, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida on May 7, 2025. The defendants include Well Trevi Tenant LLC, Watermark Retirement Communities LLC, Pasadena Avenue Tenant LLC, RUI Pasadena LLC, Caroline Blesson, Michele Thompson, and Collin Michael Baranick.

The lawsuit arises from the treatment Virginia Lenore Feith received at Elance at Pasadena (formerly known as The Fountains at Boca Ciega Bay), where she resided from January 16, 2023, until her discharge on January 28, 2024. The plaintiff alleges that during her stay at the facility operated by these entities and individuals, Virginia suffered due to inadequate care and supervision. According to the complaint, these failures resulted in physical injury and mental anguish for Virginia before her death on May 18, 2024.

Donald Joseph Feith accuses the defendants of breaching their duty to provide adequate staffing levels and failing to supervise staff properly. The lawsuit claims that these breaches violated Florida Statute §429.28 concerning residents’ rights in assisted living facilities. Additionally, it is alleged that the defendants engaged in actions that endangered residents by prioritizing revenue over resident care needs.
