Delray Beach Resident Sues Property Manager Over Negligence Leading To Severe Injuries
A Delray Beach resident has filed a lawsuit against a foreign limited liability company and an individual, alleging negligence that led to severe injuries. Richard K. Levin filed the complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on September 20, 2024, naming PMG Ocean Associates II, LLC and Jonathan Legrand as defendants.
According to the complaint, Levin was a business invitee at Winn-Dixie located in Charleston Square on January 19, 2023. As he was returning to his vehicle, he tripped and fell due to an uneven and neglected parking lot. The plaintiff asserts that PMG Ocean Associates II, LLC was responsible for maintaining the area where the incident occurred. Levin claims that the company failed in its non-delegable duty to keep the premises safe. “The negligent condition was known to Defendant or had existed for a sufficient length of time so that Defendant should have known of it,” states the complaint.
Levin further alleges that PMG Ocean Associates II, LLC breached its duty by negligently creating and maintaining a dangerous condition on the premises and failing to inspect or warn about it. He also accuses them of permitting others to create hazardous conditions. As a result of these alleged failures, Levin suffered significant injuries requiring medical treatment and leading to physical handicaps and ongoing pain.
