Customer Alleges Negligence Against Retail Giant Wal-Mart Over Premises Liability
A woman has filed a lawsuit against a major retail chain, alleging negligence that resulted in significant injuries. On November 26, 2024, Farah Tavakoli filed a complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, against Wal-Mart Stores East, LP and an unnamed store manager.
The case stems from an incident on October 11, 2022, when Tavakoli visited a Walmart store located at 35404 US Highway 19 in Palm Harbor, Florida. According to the complaint, she tripped in a ditch located in a handicapped parking spot at the store’s premises. The fall allegedly caused her substantial injuries including pain and suffering, disability, disfigurement, permanent scarring, mental anguish, and loss of enjoyment of life. Tavakoli accuses Walmart and its store manager of failing to maintain safe conditions on their property. She claims they neglected their duty to exercise reasonable care by not adequately maintaining or inspecting the parking lot and walkways for hazards.
Tavakoli’s lawsuit includes multiple allegations against Walmart. She argues that the company negligently failed to inspect or warn about dangerous conditions and did not correct known hazards despite having policies that require employees to do so. Additionally, she asserts that Walmart did not have enough staff assigned to monitor these areas for potential dangers or properly train them to handle such tasks. Furthermore, she alleges that Walmart failed to follow its own corporate policies regarding safety and did not act reasonably under the circumstances.
