Fox Chase West Condominium No. 6 Association Inc. has taken legal action against a law firm and its attorneys, accusing them of professional negligence that led to substantial financial losses. The complaint was filed by Fox Chase West Condominium No. 6 Association Inc. in the Circuit Court for the Sixth Judicial Circuit in Pinellas County, Florida, on May 7, 2025, against Monique E. Parker, Bennett L. Rabin, and their law firm Rabin Parker P.A., now known as Rabin Parker Gurley P.A.

The case revolves around a legal malpractice claim where the plaintiff alleges that the defendants failed to provide competent legal services regarding past due assessments owed by condo owners Richard G. Santoro, Linda M. Santoro, and Justin D. Santoro (the “Santoros”). According to the complaint, the association retained the defendants in June 2014 to handle outstanding assessments totaling $5,443 from February 2013 through June 2014. However, discrepancies arose when attorney Jonathan D. Peskin sent a demand letter stating an incorrect balance of $1,327.57 after applying a payment by the Santoros.

The complaint highlights that both the demand letter and Claim of Lien prepared by Peskin contained irreconcilable discrepancies regarding amounts owed for regular and special assessments over different time periods without any explanation provided to clarify which amount was accurate. This oversight allegedly resulted in a “fatal flaw” that compromised any right of foreclosure under Florida law.
