Bicyclist Sues Construction Company Over Negligence Leading to Serious Injuries
A recent court filing has brought to light a negligence lawsuit involving a construction company accused of creating hazardous conditions that led to serious injuries. On December 26, 2024, Richard Fox filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against A.R.E. Utility Construction, Inc., a Florida profit corporation.
The lawsuit stems from an incident on May 1, 2023, when Richard Fox was riding his bicycle along a sidewalk near 500 Frederick Small Road in Jupiter, Florida. According to the complaint, employees or contractors of A.R.E. Utility Construction were installing power lines and left multiple lengthy cables exposed on the sidewalk without any warning signs or barriers. As Fox rode his bicycle over these cables, he tripped and fell, resulting in severe and permanent injuries. The plaintiff asserts that he was exercising due care while bicycling and that the accident was solely due to the defendant’s negligence.
Fox’s legal team argues that A.R.E. Utility Construction failed in its duty to perform work safely and competently. The complaint lists several alleged breaches by the defendant: failing to secure an active construction site, not warning of dangerous conditions created by their work, neglecting to inspect and rectify hazards on the premises, and not adhering to industry standards for safety and traffic maintenance during construction activities. These failures allegedly resulted in Fox suffering bodily injury, pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, and ongoing medical expenses.
