The Boynton Beach attorney whose lawsuit against former President Donald Trump was dismissed by a federal judge is considering refiling his lawsuit in state court.

Lawrence Caplan sued Pres. Trump in the Southern District of Florida on Aug. 24 alleging that Trump should be banned from the 2024 ballot based on Section 3 of the US Constitution’s 14th Amendment, which states public officials who have ‘engaged in insurrection or rebellion’ may be disqualified from public office.

U.S. District Judge Robin Rosenberg, who was appointed by former U.S. Pres. Barack Obama, dismissed Caplan’s complaint for lack of standing.
