Pursuant to Rule 3-7-10, Herbert Erving Walker III has petitioned the Florida Supreme Court for Bar reinstatement.

Walker was suspended for one year effective July 5, 2020, for creating a conflict of interest by representing two clients in a criminal matter where one individual had been charged with accessory after the fact to a murder which the other client had been charged with. Walker also accepted a substantial gift from one client, who was neither a relative nor a close personal friend. The foregoing conduct was in violation of Rule 4-1.7 (Conflict of Interest, Current Client), Rule 4-1.8(c) (Gifts to Lawyer or Lawyer’s Family), and Rule 4.4.2 (Communicating with Persons Represented by Counsel) of the Rules Regulating The Florida Bar.

Any persons having knowledge bearing upon Walker’s fitness or qualifications to resume the practice of law should contact Tonya L. Avery, Bar Counsel at tavery@floridabar.org.
