Rep. Geraldine Thompson has asked the Supreme Court to reconsider its dismissal of her petition challenging the appointment of 15th Circuit Judge Renatha Francis to the Supreme Court and order Gov. Ron DeSantis to name a replacement from the earlier list of finalists submitted by the Supreme Court Judicial Nominating Commission.

The court, in an August 27 opinion, agreed with Thompson that DeSantis exceeded his authority in appointing Francis on May 26 because until September 24 she will not have been a Florida Bar member for 10 years, as required by the Florida Constitution, and hence is ineligible.

But justices dismissed Thompson’s petition because they said she sought the wrong remedy in asking that the court instruct the JNC to go back and submit a new list of nominees from the original applicants for the vacancy.
