Proposed amendments to the Rules of General Practice and Judicial Administration Rule 2.420 Public Access to and Protection of Judicial Branch Records
The Rules of General Practice and Judicial Administration Committee, in compliance with Florida Rule of General Application and Judicial Administration 2.140(b)(2), invite comments on proposed Rule 2.420 Public Access To and Protection Of Judicial Branch Records. Interested persons have until January 1, 2025, to submit any comments, electronically, to Judge Santo DiGangi, chair of the Rules of General Practice and Judicial Administration Committee and to Bar attorney liaison, Kelly Smith, at ksmith@floridabar.org.
In subdivision (e)(4)(H) and (e)(5), adds “unless the records were determined confidential under subdivision (c)(7) or (c)(8).” In Subdivision (e)(5)(A), changes 10 days to 2 business days, adds that the moving party must provide a copy of the order within 10 days after receipt of the order. In (e)(5)(B) and (e)(6), deletes that the subdivision does not apply to orders determining that court records are confidential under subdivision (c)(7) or (c)(8). The word “non-party” is replaced with “nonparty” throughout for consistency with other Florida rules of court.
