A circuit judge who was defeated in the August primary has asked the Supreme Court to invalidate the election results and declare his seat open.
Thirteenth Circuit Judge Scott Stephens said the election violates the Florida Constitution, which he argued requires that binding judicial elections be determined in the general election, not primary, balloting.
Stephens, represented by St. Petersburg attorney Daniel Schaps, filed for a writ of quo warranto just before 5 p.m. on November 2. He named Gov. Ron DeSantis and Secretary of State Laurel Lee as respondents.
