A proposed rule amendment to record and eventually release the selection of grand jury members has been deferred while a rules committee considers a broader change to record all grand jury proceedings except deliberations.

The Rules of General Practice and Judicial Administration at its June 11 meeting heard a subcommittee report that recommended amending Rule 2.535 to require that selection of grand juries be recorded. The current rule requires that only testimony before grand juries be recorded and released.

The committee wound up deferring action after it also reviewed a letter from 15th Circuit Public Defender Carey Haughwout who on behalf of the Florida Public Defenders Association asked “that all grand jury proceedings be recorded except deliberations.
