Sen. Clay Yarborough: “I filed SB 734 because the current exceptions in 768.218 are unjust and prevent accountability. This is in no way a knock against the medical profession or anyone in it.”

An effort to repeal a 1990 law that limits recovery in wrongful death actions tied to medical negligence is once again gaining steam in the Florida Senate.

The Senate Judiciary Committee voted 7-2 Tuesday to approve SB 734 by Chair Clay Yarborough, a Jacksonville business development executive. Yarborough filed a similar bill last year. A related bill in the House (HB 6017)  by Rep. Dana Trabulsy, R-Ft. Pierce, and Johanna López, D-Orlando, passed out of the House Civil Justice and Claims Subcommittee yesterday.
