In a shocking turn of events, a resident of Palm Beach County has filed a lawsuit against a local business, claiming negligence after suffering severe injuries on its premises. Michael Williams initiated the complaint against H & S Fosters, Inc., also known as Foster’s Shak, in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, on May 1, 2025.

The case stems from an incident that occurred on June 10, 2023, when Williams visited the establishment owned by H & S Fosters to play pool. Upon briefly exiting to charge his phone in his vehicle, he was confronted and shot by an individual who had been previously banned from the premises. The bullet struck Williams’ left leg, necessitating surgical intervention involving the insertion of a metal rod. The plaintiff argues that this violent encounter was preventable and attributes it to the defendant’s failure to maintain adequate security measures.

Williams’ legal representation asserts that H & S Fosters breached its duty of care owed to invitees by allowing a dangerous individual to loiter near its entrance and failing to monitor or secure the premises effectively. “Defendant had a duty to take such precautions as were reasonably necessary to protect its invitees,” states the complaint. It accuses the business of numerous oversights including inadequate security personnel, insufficient surveillance systems, and failure to enforce bans on violent individuals. Moreover, it claims that H & S Fosters should have been aware of the high crime area and prior incidents similar in nature.
