New Jersey Couple Sues Florida Businesses Over Negligence After Serious Injury
A New Jersey couple has taken legal action against two Florida businesses, alleging negligence after a serious injury occurred on their premises. Elenora Beatriz Andretta and her husband, Joseph Andretta, filed the complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on April 8, 2025. The lawsuit targets Coco’s Crush Bar, LLC and PK Developments, Inc., seeking damages exceeding $50,000.
The case stems from an incident on May 2, 2023, when Elenora Andretta visited Coco’s Crush Bar located at 317 Coronado Drive in Clearwater. While seated at an outdoor table atop a riser with minimal edge space, she fell as she attempted to stand up. According to the complaint, this fall resulted in severe injuries for Elenora Andretta. The plaintiffs allege that both Coco’s Crush Bar and PK Developments were negligent in maintaining a safe environment. “Defendant negligently designed and maintained the area where Plaintiff was injured,” states the complaint. The lawsuit accuses Coco’s Crush Bar of failing to maintain its premises safely and not warning patrons about dangerous conditions they knew or should have known existed.
PK Developments is similarly accused of negligence due to its ownership of the property where the incident occurred. The plaintiffs claim that PK Developments had a non-delegable duty to ensure safety on its premises but failed to do so adequately. Both defendants are charged with creating hazardous conditions either through direct actions or by allowing such conditions to persist without correction or adequate warning.
