Plaintiff alleges property owners’ negligence led to severe injuries
Peyton Price has filed a lawsuit seeking damages in excess of $50,000 against Sheridan A. Smith and Robert C. Smith, claiming negligence that led to her injury on their property. The complaint was filed on January 9, 2025, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida.
The incident at the heart of this legal battle occurred on May 25, 2023, when Peyton Price was lawfully present as an invitee at the premises located at 1403 W Trammell Street in Lantana, Palm Beach County. During her visit, Price suffered injuries after slipping on a slippery floor surface allegedly caused by improper tile placement not suited for outdoor use. This unfortunate event prompted Price to take legal action against the property owners.
Price’s complaint outlines several allegations against both defendants. It is claimed that Sheridan A. Smith and Robert C. Smith each had a duty to maintain their premises in a reasonably safe condition and failed to do so. They are accused of neglecting to inspect and maintain the outdoor surface adequately, using inappropriate tiles that created a concealed slip hazard, allowing this dangerous condition to persist for an unreasonable length of time, and failing to warn Price and others about these hazards.
