A lawsuit has been filed against a group of companies and individuals accused of negligence and breach of fiduciary duty in the care of an elderly woman at a rehabilitation facility. Carole Josephine Curran, represented by her attorney-in-fact Carole Castellano, lodged the complaint on November 12, 2024, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida. The defendants include Medinvest Company Limited Partnership, JBGE/Medinvest Inc., The Goodman Group LLC, JBG-Sage LLC, Theresa M. Felicione, and Scott Allen.

The case revolves around allegations that during Curran’s stays at Sabal Palms Health & Rehabilitation from December 6 to December 29, 2023, and again from January 26 to April 13, 2024, she suffered due to inadequate care and supervision. The plaintiff claims that the defendants failed to ensure proper staffing levels and neglected to provide a safe environment for Curran. The complaint states that these actions breached Florida Statute §400.022 regarding residents’ rights and caused Curran physical pain and suffering as well as mental anguish.

According to the complaint, Medinvest Company Limited Partnership held the license for operating Sabal Palms Health & Rehabilitation during Curran’s residency. It is alleged that this company along with its affiliates engaged in business activities within Florida without adequately managing or overseeing operations at the facility. The plaintiff accuses them of endangering residents by not adjusting staffing levels to meet their needs while seeking maximum census levels for increased revenue.
